In the scene when Harry, Hermione and Ron are in the # broomsticks and Prof. Slughorn joins them, the butterbeer in his cup goes from over the brim to just under it. In the shot he hasn't yet spilled it over Hermione, so there is no reason for it to keep going up and down.
